BREP Entitlements and Upgrading to Business Central from NAV2018

My client has been running NAV on premise since 2014 and is currently running NAV 2018.  They have consistently paid their BREP fees since 2014.
 
Their NAV 2018 implementation has been extensively customized.
 
Now they wish to transition to Business Central 23 but are running into Universal Code Initiative issues (note: they are not modifying any BC23 base code - just wanting to generate an onprem solution for their custom extension).
 
Microsoft documentation says that they have to purchase extra modules as they did not register their BC license before Oct 2022.
 
This, essentially, is treating them like a brand new customer.
 
In the last 6 years (since implementing 2018) they have paid a significant 6 figure sum in BREP fees.  It seems that they might have been better off financially if they didn't pay these fees and just purchased BC23 (or BC24) as a new customer.  
 
I am still struggling to get my head around this and wondering whether I am missing something.

    I know this issue was quite often for customers that wanted to upgrade to BC 21 or earlier - and there was a bug in the system code, that was causing this error. With CU of 21.6 (or 21.7) it was solved, and starting from BC22 I think this was solved. And in case You already have the bugged version implemented, it is enough to do a technical upgrade instead of full upgrade.
    Which BC version You are looking into? Could be the old bug is back.. but hopefully not.
